Terms and Conditions of Ordering and Delivery for Specialist Retailers
Only orders that have been received in writing by WARIMEX GmbH or by email to diddl@warimex.de by no later than the communicated end of the respective ordering period can be processed.
The minimum order value is €1,500.
All prices are net/net, plus the applicable statutory VAT.
Delivery within Germany is free of charge.
Transport costs to Switzerland or Austria are charged separately and added to the quoted price.
Upon placing the order, a deposit of 40 % of the net order value is due.
The remaining payment of 60 % is due net/net within 14 days of receipt of the goods.
New customers are requested to enclose a current extract from the commercial register with their order.
Illustrations, graphics, colours and dimensions are non-binding and are provided solely for reference. We reserve the right to make changes.
Diddl products are sold exclusively through authorised distribution partners.
The acceptance of orders by WARIMEX GmbH is subject to change, is not binding and is assessed individually for each customer.
A contract is only concluded upon written order confirmation from WARIMEX GmbH.
The retailer is only deemed an authorised distribution partner upon written confirmation from WARIMEX GmbH.
Delivery dates are non-binding and do not constitute fixed dates. Delays in delivery do not entitle the customer to withdraw from the contract or to claim damages.
Delivery is subject to availability of goods and timely supply from our own suppliers.
Partial deliveries are permitted and are deemed to be separate deliveries.
In the event of failure to receive the deposit by the due date, WARIMEX GmbH expressly reserves the right to withdraw from the order.
The goods remain the property of WARIMEX GmbH until full payment has been made.
Claims for damages – regardless of their legal basis – are, to the extent permitted by law, excluded. This applies in particular to loss of profit and indirect damages.
There are no verbal side agreements. Amendments and additions must be made in writing.
German law applies. The place of jurisdiction is, to the extent permitted by law, the registered office of WARIMEX GmbH.
